Terms and Conditions of Use

Access to and use of this site is provided by Newry, Mourne and Down District Council (“Newry, Mourne and Down”, “us”, “we”) subject to the following Terms and Conditions ("Terms"). 

BY USING OUR SITE YOU ACCEPT THESE TERMS AND CONDITIONS

• Use of this site constitutes your acceptance of these Terms in full which take effect when you first use this site. If you do not agree to these Terms, you must not use our site. Newry, Mourne and Down District Council reserves the right to change these Terms at any time by posting changes online. You are responsible for reviewing regularly information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes your acceptance of these Terms as modified by the posted changes.

WE MAY SUSPEND OR WITHDRAW OUR SITE

• Whilst Newry, Mourne and Down District Council endeavours to ensure that this site is normally available 24 hours a day, Newry, Mourne and Down District Council will not be liable if for any reason the site is unavailable or interrupted at any time or for any period. 
• Access to this site may be suspended temporarily or permanently and without notice.

• Newry, Mourne and Down District Council is the owner or the licensee of all intellectual property rights in our site, and in the material published on it or reproduced with permission from copyright holders or owners of Intellectual Property Rights.  Newry Mourne and Down District Council acknowledge permission to use copyright material on this site.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
• Save for content which is specifically stated as not available to be copied, downloaded or transmitted to others, you may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.  You must not copy, download or transmit to others pages or contents of this site which is noted as not available for printing, copying or transmitting.

• Whilst Newry Mourne and Down District Council endeavours to ensure that the information on this site is correct, we make no representations, warranties or guarantees, whether express or implied, as to its accuracy. The content on our site is provided for general information only. 
• Our content may from time to time be available to translate to such language other than the English language via an automated translation system. Newry Mourne and Down District Council makes no representations, warranties or guarantees, whether express or implied, as to the accuracy of such automated translation, or any translation carried out by third parties.  
• Where a Euro rate is quoted on our site, this is for guidance only.  Exchange rates may fluctuate on a daily basis and Newry Mourne and Down District Council recommends that you check any exchange rates used on our site.

• This site has an accommodation search facility that provides users with details of different accommodation.  The Accommodation save for the Campsite at Kilbroney Park, Rostrevor is owned, controlled or made available by third parties (“the Accommodation Providers”). The Accommodation Providers are responsible for the Accommodation and all booking contracts. The booking of Accommodation takes place solely on the platforms of the Accommodation Providers. The Accommodation Provider’s terms and privacy policies apply to your booking, so you must agree to, and understand those terms.
• This site is used to promote Events including third party Events.  The third party Event Organisers are responsible for those Events and booking of the Events takes place solely on the platforms of the Events Organiser and their terms and conditions and privacy policies apply to your booking, so you must agree to and understand those terms.
• Part of this site contains materials submitted to Newry Mourne and Down District Council by third parties. Third parties are responsible for ensuring that materials submitted for inclusion on this site comply with national and relevant foreign law. Newry Mourne and Down District Council cannot guarantee the accuracy of this material and hereby expressly disclaims any responsibility for error, omission or inaccuracy in the material. Newry Mourne and Down District Council suggests you seek confirmation of the accuracy and currency contained within the information from the establishments or individuals or organisations concerned. 

LIMITATION ON OUR LIABILITY

• We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
• We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
• We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
  • use of, or inability to use, our site; 
  • use of or reliance on any content displayed on our site; or 
  • any action or decision taken by you as a result of using this site or any such content.
• In particular, we will not be liable for:

  • business interruption;
  • loss of anticipated savings;

• Newry Mourne and Down District Council does not accept any responsibility or liability to any party for any loss, damage, costs, personal injury or death howsoever arising, whether directly or indirectly, whether in contract, tort or otherwise in connection with, your attendance at any location which is not owned by Newry Mourne and Down District Council or an event not organised by Newry Mourne and Down District Council featured on this site. 
• Newry Mourne and Down District Council does not accept any responsibility or liability to any party for any loss, damage or costs howsoever arising, whether directly or indirectly, whether in contract, tort or otherwise in connection with, any change to, cancellation or delay of an event featured on this site. 

Any material downloaded or otherwise obtained or accessed through your use of the site is done so at your own discretion and risk. You will be solely responsible for any damage, loss or prejudice to the your own or any third party computer system or other device or loss of data that results from the download or access of any such material.  Newry Mourne and Down District Council will not be liable for any loss or damage caused by a virus, distributed, denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.”

VIRUSES

• We do not guarantee that our site will be secure or free from bugs or viruses.
• You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
• You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately. 

GENERAL 

• Failure or neglect by us to enforce any of these provisions of these Terms at any time shall not be construed or deemed to be a waiver of our rights, nor shall this in any way affect the validity of the whole or any part of these Terms, nor prejudice our rights to take subsequent action. 
• If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable, then the remainder of such provisions and all other provisions of these Terms shall continue to be valid and enforceable to the fullest extent permitted by law. 

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Northern Ireland and the parties submit to the exclusive jurisdiction of the courts of Northern Ireland. This, however, shall not prevent Newry Mourne and Down District Council from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these Terms in any other jurisdiction.
